Terms:
Acceptance
of orders; contrary terms; Acceptance of buyer’s order is conditioned upon
buyer’s assent to the following terms and conditions, and any inconsistent
provision of any purchase order or other writing shall not constitute a part of
the contract of sale. If any of there
terms and conditions are not acceptable to Buyer, Advanced Handing Services
must be notified promptly.
PRICING & SPECIFICATIONS: All prices in the Advanced Handling catalog or
electronic media reflect the Buyer’s net cost in U.S. currency. Minimum order
amount is $35.00 not including shipping, in some cases this minimum maybe waved
for a extra handling or broken case charge. The
prices do not include freight, applicable federal, state, and local taxes,
charges, and duties, or special crating requirements for shipment or
export. Buyer shall pay all such costs,
taxes, charges, and duties. Prices,
colors, and specifications are subject to change without notice.
PAYMENT TERMS: Open account terms of 1% 10 Days, Net 30 Days
after shipment are extended to firms listed and satisfactorily rated by Dun and
Bradstreet and INFO USA. Un-rated or
unlisted firms are request to pay in advanced or by credit card for their first
initial order.
Late fees of 1-1/2% per month
on unpaid balances will apply after 30 days from invoice date.
EXCLUSIVE WARRANTY: All products are warranted by
the manufacture to the extent of the manufacture’s express warranties. Workforce, Inc. DBA Advanced Handling Services or any of its
subsidiaries shall not be liable, under any circumstances, for consequential or
incidental damages, including, but not limited to labor costs or loss of
profits arising in connection with the use of or inability to use products
purchased from Workforce, Inc. DBA Advanced Handling Services or any of its subsidiaries or
contractors.
SHIPPING: All items ship promptly from factory stock
(usually within 7 to 10 working
days). All items ship FOB Shipping
Point via common carrier. Unless otherwise requested by
Buyer, goods will be shipped via carriers of our choice with shipping,
handling, and packaging charges prepaid and added to the invoice. Any extra charges for services requested by
Buyer, i.e., special routing, inside delivery, or pre-delivery notification
must be paid by consignee.
DAMAGED SHIPMENTS; RISK OF LOSS: Buyer should
thoroughly inspect all items for shipping damage before accepting
delivery and note all damage on the freight bill before signing. If you or
your company representatives sign for the material as received in good condition
there is nothing we can do your only recourse is to call the freight carrier and
file a concealed damage claim. If damage
has occurred, Buyer should note the extent of the damage on the freight bill
before delivery driver leaves and call 888-376-5020 immediately. Concealed
damage must be reported within 72 hours from receipt of goods.
RETURNED GOODS:
Are not accepted unless written authorization has been given by Advanced
Handling Services and will be subject to manufactures restocking charges and
refurbishing charges plus freight charges to and from distribution or
manufacturing points. Specials or modified equipment are
NON-RETURNABLE. Return of goods MUST be within the first 30 days from
original shipment date. All returns are subject to inspection, any
missing or damaged equipment will be refused.
CONTROLLING LAW: The validity, construction and enforcement of
the purchase agreement between Advanced Handling Services and Buyer shall be
governed by and interpreted under the laws of the State of Pennsylvania, in the County of Lehigh.
